Copyright registration in India differs from patent registration as it safeguards expressions rather than ideas. Consequently, multiple inventions or ideas can be protected, ensuring that others cannot copy the resulting work without proper authorization. The duration of copyright registration in India is 60 years. It is possible to register copyright for various activities such as music, manuscripts, books, literary works, films, performances, paintings, fashion designs, training manuals, computer software, and more.

The Copyright registration process in India contains extensive and precise series of steps.

Step 1 involves submitting the copyright application form to the relevant Copyright Registrar, providing detailed information about the work in question. Depending on the nature of the work, separate applications may be required.

Step 2 mandates that the applicant signs the application form and entrusts an authorized Power of Attorney to a qualified Advocate for further processing. The duly completed application, along with all necessary documents, must then be electronically submitted to the Registrar of Copyrights Online.

Step 3 includes the issuance of a Diary number once the application has been successfully filed online.

Step 4 entails the thorough review of the submitted application by a Copyright Examiner, who identifies any potential discrepancies or objections within 30 days.

Step 5 comes into play if any discrepancies or objections are identified, leading to the issuance of a discrepancy notice. The recipient of this notice is given 30 days to address and resolve the concerns raised.

 

Step 6 marks the conclusion of the process, where the application is deemed satisfactory or resolved. In such cases, the Copyright Office officially certifies the copyright and grants the Extracts of Register of Copyrights (ROC), serving as the Registration Certificate of copyright.

Once the initial step of the copyright registration process is completed, a diary number will be provided, and the entire registration process will typically be finalized within approximately 12 months from that date.
