  • Identification of Parties: Both the employer and employee involved in the agreement need to be clearly identified. This normally includes their names, addresses, and other relevant identifying information.
  • Job Title & Description: Ensure that the employment agreement specifies the job title and the profile of the position the employee is being hired for. This should include a detailed description of the duties and responsibilities the employee will hold in this role.
  • Compensation & Reimbursements: The salary the employee will earn for their services should be clearly outlined in the contract. This section should also include a detailed breakdown of different salary components such as basic wage, health benefits, travel reimbursement, PF contributions, and more. The contract must also include a section detailing the compensation entitled to the employee for any expenditure incurred during the execution of their duties.

·         Employee Leaves and Additional Benefits

The employment contract should contain a section detailing the number of paid leaves the employee is entitled to each year, as well as the procedure for availing them. Any other benefits, such as incentives, bonuses or appraisals, that the employee is eligible for should be clearly specified.

Format of Employment Contract

Terms of Employment

The designated employee agrees to execute their duties prescribed by the employer to the best of their capabilities in a trustworthy manner. At all times, the Employee is required to comply with all company regulations, norms, and processes.

Job Responsibilities

The Employee is expected to perform all the necessary roles and duties associated to their [job title]. The Employer reserves the right to occasionally assign extra tasks, provided they align with the Employee's job scope.

Remuneration

The Employee will earn ₹__________ [per hour/per annum] for the services provided. The Employee's performance will be evaluated on a [quarterly/annual] basis. The wage will be subjected to standard employment deductions - taxes, social security, and medical care.

Benefits

Probation Period

Working for employers who are associated or compete directly with the Employer during your employment period here is not permissible. Any alternative employment relationships you're engaged in must be transparently shared with your Employer. Furthermore, you are welcomed to pursue other employment opportunities, on the premise that it does not compromise your performance in your current role and it does not potentially risk the interests of the Employer.

Upon confirmation, the Employee agrees not to solicit any of the Employer's clients for a minimum duration of (specified time period), upon termination of their current employment.

Full Agreement

This contract replaces any previous agreements, whether written or spoken, existing between the two parties. It now represents the complete understanding between them. This employee contract can undergo changes, however, such updates require mutual consent from both the employer and the employee.

Legal Authorization

The employee, adhering to the law of (Country), confirms they have the necessary permissions to work there. All related documents will be procured by the employer for their official records.

Validity

In a situation where a certain provision of this agreement is deemed invalid or unenforceable, all other clauses will persist with full force and effect. It is understood that the invalidity of any single clause does not affect the rest of the agreement.

Legal Framework
